These Terms of Use ("Terms") govern your use of the BrainTokens mobile application ("App") developed by Rise Above The Chaos ("we," "us," or "our"). By downloading, installing, or using the App, you agree to these Terms.

1. Eligibility and Parental Consent

The App is designed for children ages 6 and older under parental supervision. A parent or legal guardian ("Parent") must set up and configure the App. By setting up the App, you represent that you are at least 18 years old and the parent or legal guardian of any child who will use the App.

2. License

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App on devices you own or control, subject to these Terms and the Apple Media Services Terms and Conditions.

3. Subscriptions and Payments

The App offers auto-renewable subscription plans:

Annual — $49.99/year
Monthly — $7.99/month
Lifetime — one-time purchase, $79.99

Billing:

Payment is charged to your Apple ID account at confirmation of purchase
Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period
Your account will be charged for renewal within 24 hours prior to the end of the current period
You can manage and cancel subscriptions in your Apple ID Account Settings

If a free trial is offered, any unused portion of the free trial period is forfeited when you purchase a subscription.

4. Acceptable Use

You agree not to:

Reverse engineer, decompile, or disassemble the App
Use the App for any unlawful purpose
Attempt to bypass parental controls or PIN protection
Redistribute or sublicense the App

5. Intellectual Property

All content, features, and functionality of the App (including exercises, artwork, animations, and sounds) are owned by Rise Above The Chaos and are protected by copyright and other intellectual property laws.

6. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

The App is an educational supplement and is not a substitute for professional education, tutoring, or learning disability assessment.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, RISE ABOVE THE CHAOS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APP. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE 12 MONTHS PRECEDING THE CLAIM.

8. Screen Time Management

The App's screen time features rely on Apple's FamilyControls framework. We are not responsible for any limitations, changes, or issues with Apple's Screen Time APIs. Screen time rewards are a motivational tool and do not constitute a guarantee of educational outcomes.

9. Termination

We may terminate or suspend your access to the App at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users or us.

10. Changes to Terms

We reserve the right to modify these Terms at any time. Continued use of the App after changes constitutes acceptance of the modified Terms.

11. Governing Law

These Terms are governed by the laws of the State of California, without regard to its conflict of laws provisions.

12. Apple's Standard EULA

To the extent not covered by these Terms, your use of the App is also governed by Apple's Standard End User License Agreement (EULA).
